I know you mean well with the title but I feel a little odd because Fabien is the brains behind Fruit and Ches64. I am just lucky enough to be involved and the hobby is a lot of fun for me. I can only say that I prefer that you will not release it as free program.
It is better if you do it commercial or if you do not release it.
In case that you choose to do it commercial then I think that it is better not to give it copy protection(assuming it is going to be weaker than rybka2.3.2a).
People who get programs by illegal means are going to get rybka2.3.2a that has no copy protection from friends and are not going to buy fruit because of copy protection and copy protection only can cause you to spend time for nothing and to lose customers.

In a way I wish I could justify releasing Fruit open source but I do not plan on it because it could punish hard working commercial programmers who I respect. Because Fruit does not come with a GUI or support I think free closed source still makes sense. I don't know what method of release Chess64 will use if any but that choice is going to be whatever Fabien feels is best and I will support whatever he chooses.

I don't think Fruit is ever going to be commercial again, maybe Chess64 will.
the question is whether it will come with its own gui that support wb/uci engines since I have heard that Fabien is working on it.
I have not heard about a GUI but that does not mean it wont happen. Fabien is a Linux user though so I would not count on a new windows GUI any time soon.

I think that releasing fruit as free closed source also can punish hard working commercial programmers because honest people who pay for commercial chess programs that they use may decide simply to use fruit instead of buying commercial programs.
Fruit can be used under existing GUI so the fact that it does not come with a GUI may be meaningless for them(not everybody is interested in new gui).

That's the choice that all programmers have Uri and it just means that commercial authors will have to work harder to keep ahead of the free competition.

How do you know that not everybody is interested in new chess GUI,atleast the majority might be interested in a gui if it has more features than shredder classic and arena.
Fabien did really go commecial with fruit 2.2.1 after getting convinced from group of commercial programmers, he then later decided to release fruit freely,he has alway beeen altruistic and helpful to computer chess hobbyists,not to forget the gentle and very friendly attitude of his to others.
if future commercial programmers such as you have a reason for him to go commercial with his new engine, i'm sure he would be helpful to you

Ryan Benitez is certainly pretty good at improving stronger engines which is so harder for programmers to improve, I get a lot faster fruit and more improved one,I was amazed that it had once finished 2nd in freeware engine rankings in blitz when it usually finished around 8th.

But Robert Hyatt and Tord Romstad would not release their engine commercial, why Fruit need to go commercial again after it went commercial and finally back as freeware?maybe chess64 going commercial because it has mp support might be a good idea.
